KIWI PEAR TERMS OF USE Effective: 15 August 2026 · Version 2026-08-15.4 1. AGREEMENT By using Kiwi Pear after accepting the current Terms, Privacy and Usage Policy, you agree to them. Non-waivable rights remain unchanged. 2. WHAT KIWI PEAR IS Kiwi Pear by Jamoy Tulloch is an AI and automation system. It may use replaceable models, tools, agents, research, memory, files, APIs, cloud services and HPC. AI can be wrong. Important legal, medical, financial, education, employment, safety and other consequential matters require the qualified human review required by law or professional rules. 3. USER AUTHORITY Use Kiwi Pear only with lawful authority. You are responsible for data, accounts, tools and external actions you knowingly authorize. Do not use Kiwi Pear to break law, violate rights, bypass access controls, steal credentials, infringe intellectual property, unlawfully scrape/paywall-bypass, or misuse another AI provider. 4. THIRD PARTIES / IP Third-party models, websites, APIs and software keep their own terms, licences and privacy rules. Kiwi Pear does not make third-party Output automatically eligible for training or distillation. Required licence/attribution notices remain intact. 5. SERVICE / LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kiwi Pear is provided “AS IS”, “AS AVAILABLE” and “WITH ALL FAULTS”. No guarantee is made of accuracy, availability, security or fitness. Where liability may lawfully be excluded, it is excluded. Where it cannot be fully excluded, total aggregate operator liability is limited to the greater of direct Kiwi Pear fees paid in the previous 3 months or JMD $10,000, unless mandatory law requires more. Indirect, consequential, punitive, lost-profit, lost-data and similar losses are excluded to the lawful extent. 6. INDEMNITY To the maximum lawful extent, you indemnify the operator against third-party claims caused by your unlawful Input, unauthorized actions, misuse, rights violations or breach of these policies. 7. DISPUTES Give 30 days' written dispute notice where lawful. Arbitrable disputes are resolved individually under Jamaica's Arbitration Act with Jamaica as the seat and remote/document proceedings preferred. Court/class/jury waivers and the 12-month claim period apply only to the maximum extent enforceable. The operator may seek lawful urgent relief for fraud, abuse, security, IP/confidentiality, unauthorized access, payment, evidence preservation or arbitration enforcement. Mandatory user rights remain. 8. GOVERNING LAW Kiwi Pear is governed primarily by Jamaican law, including especially the Consumer Protection Act, Arbitration Act, Electronic Transactions Act, Data Protection Act and Cybercrimes Act, together with other applicable Jamaican law. Mandatory foreign/international-region rules apply only when they legally govern a user or deployment.
